A three-level system: Federal Spatial Planning Act (SPA), cantonal planning and construction laws, and municipal regulations. The permit procedure is essentially cantonal.

Public Inquiry

Every construction project requiring a permit is subject to public inquiry (art. 22 SPA). Published in the official gazette and posted on-site. Typically 30 days (varies by canton). Any interested person may consult the file and file an opposition.

Standing

Direct Neighbours

Must have a practical and current interest: specially affected by proximity. Not based on a fixed distance but on the project's concrete impact (view, sunlight, noise, traffic) - ATF 133 II 249.

Organisations

Nature and heritage protection organisations with standing under the Federal Act on Nature and Landscape Protection (art. 12 NHLPA).

Opposition Content

Written, motivated, within the public inquiry period. Must indicate: opponent's identity and standing, the contested project, grievances (distance violations, height excess, sunlight obstruction, non-conformity with zoning plan, environmental impact), and conclusions (refusal, modification, conditions).

After Opposition

The municipality decides: grant the permit rejecting oppositions, refuse, or grant with conditions. Decision appealable to the cantonal authority (CDAP in Vaud) within 30 days, then Federal Supreme Court (art. 82 et seq. FSCA).

Common Grounds

Non-conformity with zoning plan, distance/height violations, heritage impact, environmental impact (impact assessment for major projects, art. 10a EPA), neighbourhood rights violations (view, sunlight, excessive immissions - art. 684 CC).

Duration

Opposition followed by appeals can delay a project by months to years. Complex proceedings may last 3-5 years.
