Article 47 of the Banking Act (BA) protects bank confidentiality. However, since the introduction of Automatic Exchange of Information (AEI) in 2017, Switzerland transmits financial data to over 100 associated countries. In tax matters, bank secrecy no longer shields against foreign tax authorities.

Bank secrecy remains in effect vis-à-vis private third parties and in civil matters. A breach of bank secrecy is punishable under criminal law (Article 47 BA). Swiss criminal authorities may access banking information with a court order.
